This Privacy Policy describes how Fair Energy Alliance (“we,” “us,” “our”) collects, uses, discloses, and sells* Personal Information when you use our websites, mobile experiences, and related pages (collectively, the “Websites”) and when we operate our referral and advocacy services that help you explore lower-cost residential energy options, including alternative energy providers, rooftop solar, and home-efficiency upgrades (collectively, the “Services”). If you do not agree with our policies and practices, please do not use the Websites or Services.

*“Sell,” “Share,” and other capitalized terms are used as defined by applicable privacy laws (e.g., the CCPA/CPRA).

1) Information We Collect

We may collect information that identifies, relates to, describes, or can reasonably be associated with you (“Personal Information”), including:

Identifiers: name, email address, phone/mobile number, mailing address, utility account details you provide, and unique identifiers.

Demographics / Protected Classifications (where permitted): age/date of birth (to verify eligibility).

Commercial & Profile Data: homeownership status, energy usage or bill range, utility provider, interests, communications preferences, feedback, and customer-service history.

Internet/Network Activity: IP address, device and browser data, pages viewed, referring/exit pages, ad interactions, session recordings (e.g., for compliance and UX), and similar information collected via cookies, pixels, tags, and scripts.

Geolocation: general location (from IP) and, if you enable/submit it, more precise location at registration.

Audio/Visual/Electronic: call recordings (where permitted by law), and proof-of-consent logs (e.g., checkbox timestamps, session captures) for compliance.

Professional Info (B2B contacts): company, title, role.

Inferences: insights drawn about likely interests or eligibility for certain energy options.

2) How We Collect Information

Directly from You: when you complete forms, request options, ask questions, or otherwise contact us.

Automatically: via cookies, pixels, tags, SDKs, JavaScript, log files, analytics tools (e.g., Google Analytics/Tag Manager), session replay, and similar technologies that capture usage, attribution, conversions, and compliance records.

From Third Parties: data partners, service providers, marketing/advertising platforms, public databases, and utility/energy market data sources (where lawful).

Proof of Registration & Consent: For legal compliance, we may record your interaction with forms (e.g., video/screen/session recording, clickstream, time/date, IP, user agent, checked consent boxes) and retain such records for up to five (5) years.

3) How We Use Information

We use Personal Information to:

Provide & Operate Services: qualify your needs, match you to potential providers (e.g., alternative energy suppliers, solar installers, efficiency contractors), and facilitate introductions.

Communicate: respond to inquiries; send confirmations, updates, and educational materials; and (where permitted) deliver marketing by email, SMS, phone, and ads.

Match & Optimize: decide which vetted providers are most relevant; improve routing, eligibility logic, and referral outcomes.

Analytics & Improvements: measure performance; debug; prevent fraud and abuse; enhance UX and accessibility.

Marketing & Interest-Based Ads: personalize content and advertising on our Websites and across other websites/apps/platforms (see “Your Choices” below).

Compliance & Enforcement: maintain proof of consent; comply with laws; enforce terms; protect security and rights.

We may combine information from various sources to improve accuracy and relevance.

4) How We Disclose, Share, or Sell Information

We may disclose, share, or sell Personal Information as follows (subject to applicable law):

A. Third-Party Energy & Home Services Providers (Core Referral Purpose).

We disclose, share, and may “sell” your Personal Information (as defined by the CCPA/CPRA) to third-party providers to deliver the options you requested (e.g., alternative energy suppliers, solar installers, efficiency contractors) so they can contact you directly.

B. Service Providers / Contractors.

We disclose information to vendors that operate our Websites/Services (hosting, analytics, verification, compliance capture, communications, lead/consent management, ad tech).

C. Marketing & Ad Tech Partners.

We disclose or “share” information with advertising networks, social platforms, and analytics providers to measure campaigns and deliver interest-based ads.

D. Corporate Transactions.

If we undergo a merger, acquisition, asset sale, financing, bankruptcy, or similar event, information may be transferred as part of that transaction.

E. Compliance, Safety, and Rights.

We may disclose information to comply with legal processes, respond to lawful requests, enforce agreements, and protect our users, systems, or rights.

F. Aggregated/De-Identified Data.

We may share or sell aggregated or de-identified information that does not reasonably identify you.

5) Your Choices & Opt-Outs

Email/SMS/Calls. You can unsubscribe from marketing emails via the link in each message, reply STOP to marketing texts, and request to be added to our internal Do-Not-Call list via the Contact Us methods below. (You may still receive transactional or service messages.)

“Do Not Sell or Share My Personal Information.” If you are a California resident (or where applicable under other state laws), you may exercise your opt-out rights via our Do Not Sell or Share link or by contacting us (see Section 9).

Browser “Do Not Track.” Our Websites may not respond to all DNT signals.

6) Children’s Privacy

Our Websites and Services are not directed to children under 16, and we do not knowingly collect Personal Information from them. If we learn we have collected such data, we will delete it.

7) Data Security

We use reasonable administrative, technical, and physical safeguards (e.g., access controls, logging, network protections) to protect Personal Information. No method of transmission or storage is 100% secure; use the Services at your own risk.

8) Data Retention

We retain Personal Information as long as reasonably necessary for the purposes described here, to comply with law, resolve disputes, enforce agreements, maintain proof of consent/registration, and for legitimate business interests. When retention is no longer necessary, we will delete, de-identify, or securely store data until deletion is feasible.

9) Changes to this Policy

We may update this Privacy Policy at any time. Changes are effective upon posting to the Websites. Your continued use signifies acceptance. Please review periodically.
